LADURÉE CLUB GENERAL TERMS AND CONDITIONS
ARTICLE 1: Preamble
1.1 PATISSERIE E. LADUREE, a simplified joint-stock company with a capital of €372,584.80, registered with the Paris Trade and Companies Register under number 572 045 540, whose registered office is located at 84 avenue d'Iéna, 75116 Paris, FRANCE (hereinafter "LADUREE"), has created and manages a loyalty program called "Le Club LADUREE" (hereinafter the "Program") for its customers making a purchase in one of the eligible Ladurée boutiques (see §1.2) or on the website www.laduree.fr (hereinafter the "Website").
1.2 These general terms and conditions relating to the Program (hereinafter the "General Terms and Conditions") are intended to define the terms of membership and operation of the Program. Any person joining the Program is deemed to have read and accepted these General Terms and Conditions without reservation.
The Program is valid for purchases made on the Website and in the following Ladurée boutiques:

(hereinafter the “Boutiques”).
1.3 As the General Terms and Conditions may be subject to subsequent modifications, the version applicable to the customer's purchase is the one in effect on the Website on the date the order is placed. These terms and conditions shall prevail over any other version or contradictory document. LADUREE therefore invites customers to carefully review the current General Terms and Conditions with each new order.
ARTICLE 2: Purpose The Program allows its members (hereinafter referred to as the "Member(s)") to benefit from advantages, services, and/or offers provided by LADUREE.
ARTICLE 3: Membership and Validity 3.1. Membership is open to any individual of legal age (18 years and older). It is not possible for a legal entity (company, professional organization, association, etc.) to benefit from the Program. If you checked the "professional" box when creating your web account, you cannot benefit from the advantages of the "Ladurée Club."
3.2. Only one membership application per person will be considered. LADUREE may request at any time any document that verifies the identity of the person wishing to subscribe to or who has subscribed to the Program, particularly in the event of identical names.
3.3. Registration for the Program is free and is offered on the LADUREE website when creating an account at www.laduree.fr or during a purchase in stores via a form available on tablets or by scanning a QR code with the customer's mobile phone, or directly with a sales advisor.
To join the Program on the website www.laduree.fr, the customer must create an account in the designated section.
3.4 Registration forms containing incomplete or incorrect data will not be processed. The Member is responsible for the accuracy of the data they provide during registration. The Member may modify their personal information by contacting customer service via the contact form on the website or by email at contact@laduree.com.
3.5. Membership in the Program implies acceptance of these General Terms and Conditions by the Member. These General Terms and Conditions are available on the LADUREE website www.laduree.fr. Once membership is validated, the Member will receive a welcome email from which they can download a digital card and review these General Terms and Conditions.
ARTICLE 4: Content
4.1 The Program allows Members to receive communications relating to Maison Ladurée and the events it organizes. In addition, Members will benefit from advantages such as a gift with purchase on their birthday and access to Ladurée private sales.
4.2 The list of benefits offered may be modified at any time by Ladurée.
4.3 Ladurée benefits may under no circumstances be transferred or exchanged for cash.
ARTICLE 5: Benefits
5.1. Notification of the benefit: The Member will receive an email indicating a benefit or a discount code to use on the Website and/or in Stores.
5.2 Obtaining the benefit: the Member may benefit from his benefits i) on the Website after identifying himself, and by entering his code at the time of purchase or (ii) directly in Stores by presenting his LADUREE digital card (iii) by giving his name at the till to the sales advisor.
5.3 Non-cumulative with LADUREE employee benefits: It is specified that LADUREE employees registering with their professional @laduree.com email address will not be able to benefit from the employee benefits program in addition to the specific benefits reserved for employees. LADUREE employee members must choose either to benefit from the discounts associated with their status or to participate in the program.
ARTICLE 6: Linking customer accounts created in stores and created on the website
When a Member has opened an in-store account to benefit from the Program and subsequently wishes to link an online order to their loyalty account, they must:
1/ Choose the option to open an account on the website www.laduree.fr;
2/ Use the same email address as the one provided in stores during registration. The account number linked to the Program will then be directly associated with the Member's Web account.
ARTICLE 7: Personal Data
7.1. Registration for the Program requires the Member to provide the information listed below upon joining:

Country of residence (in stores)
Postal code
Date of birth
Phone
Language preference
Information marked with an asterisk (*) is mandatory during registration. Information other than that mentioned above is optional. Members are encouraged to provide it to receive news and offers more likely to be relevant to them.
7.2. The information collected, based on the consent of the Member or prospective Member, during their membership and during the use of the Program, is processed by LADUREE's services for the following purposes:
Consider memberships and manage the Program;
Communicate LADUREE information, commercial offers and promotional offers to the Member.
7.3 In accordance with applicable regulations regarding the protection of personal data, the Member may, at any time, decide to withdraw their consent by sending an email to privacy@laduree.fr or by post to the following address:

The user can also view and modify the information provided by contacting customer service at contact@laduree.com. Specific information regarding the processing of the Member's personal data is detailed in the Data Protection Charter available here.
The Member may also lodge a complaint with the National Commission for Information Technology and Freedoms ("CNIL"), the supervisory authority in charge of compliance with obligations regarding personal data.
ARTICLE 8: Termination
8.1 Termination by the Member
8.1.1 At any time, the Member may choose to terminate their membership in the Program either by clicking on the unsubscribe link in the emails received or by contacting customer service.
8.1.2 After reconfirmation, the Member will then be automatically unsubscribed and will no longer be able to benefit from the advantages of the Program.
8.2 Termination by LADUREE
8.2.1 LADUREE reserves the right to modify the Program at any time without prior notice. These modifications will be communicated to the Member by any means within a reasonable timeframe. If the Member does not accept these modifications, they are free to terminate their membership.
8.2.2 LADUREE reserves the right to terminate the Program at any time by providing one (1) month's notice. In the event of definitive termination of the Program, the Member will be notified by email and will have no recourse against LADUREE whatsoever, for any reason whatsoever. The Member will then have a period of three (3) months from the date of notification of the Program's termination to continue to enjoy and use the corresponding benefits, if applicable. No requests will be accepted after the expiry of this period.
ARTICLE 9: Responsibility
LADUREE shall not be held liable for any delay, loss, or misdelivery of mail, including mail sent to an incorrect address, or for telephone and internet connection problems that delay or prevent the fulfillment of its obligations under the Program. While LADUREE has taken care to ensure that all information provided by or to the Member is correct, LADUREE cannot be held liable for any errors in the content of the information, nor for any consequences thereof. LADUREE shall not be held liable for the unavailability of benefits, services, and exclusive offers.
ARTICLE 9: Applicable Law
These General Terms and Conditions are governed by French law to the exclusion of all others. The Member has the option of resorting to a consumer mediator, under the conditions set out in Articles
Articles L.611-1 et seq. of the Consumer Code. Any dispute that cannot be resolved amicably shall be brought before the competent court in accordance with the provisions of ordinary law in this matter.
